The Court of Appeal in Abuja on Tuesday upheld the lower court’s ruling that reinstated Philip Shaibu as the Deputy Governor of Edo State.

In its judgment, the appellate court dismissed the appeal filed by the Edo State House of Assembly, which sought to uphold Shaibu’s impeachment.

EDITOR’S PICKS

Shaibu was initially impeached on April 8, 2024, after the state Chief Judge, Justice Daniel Okungbowa, convened a seven-member committee to investigate allegations of misconduct against him. Although the committee found no evidence of perjury, it did find Shaibu guilty of disclosing government secrets, leading to his impeachment.

However, on July 17, Justice James Omotosho of the Federal High Court in Abuja nullified the impeachment and ordered Shaibu’s immediate reinstatement. Justice Omotosho ruled that the grounds for the impeachment were legally untenable and amounted to gross misconduct.

The court further directed the Inspector-General of Police to provide Shaibu with the necessary security to resume his duties until the end of his tenure. It also warned that anyone other than Shaibu claiming to be the deputy governor would face legal consequences.

Additionally, the court nullified the appointment of Omobayo Godwin, who had been named the new deputy governor following Shaibu’s impeachment.
