S’Court Orders Retrial Of Ogun PDP Governorship Legal Tussle

The Supreme Court has ordered the retrial of the Ogun PDP governorship legal battle.

EKO HOT BLOG reports that the Supreme Court in Abuja has ordered that the legal action which arose on the conduct of the primary election of the Peoples Democratic Party, PDP, for the nomination of the governorship candidate in Ogun State be retried by the Federal High Court in Abuja.

In a judgement delivered on Monday, Justice Ibrahim Saulawa held that it was wrong of the Federal High Court in Abuja to have declined jurisdiction when in actual fact the constitution of the country conferred jurisdiction on it.

In a unanimous judgement of a five-man panel of the apex court, it was ordered that the suit be returned to the Chief Judge of the Federal High Court for reassignment to another judge.

Justice Saulawa upheld the decision of the Court of Appeal in Abuja which had earlier directed that the suit be heard afresh by another judge.

The apex court ordered that the suit be expeditiously heard and fully determined within the time allowed by law.

Justice Taiwo Taiwo of the Federal High Court in Abuja had declined to entertain the suit filed by Jimmy Adebisi Lawal on the ground that it was an internal affair of the PDP.
