Gospel Singer Sinach Sued for Copyright Infringement on Song ‘Way Maker’

The Federal High Court in Lagos has adjourned the copyright infringement lawsuit filed by music producer Michael Oluwole against gospel singer Sinach until January 2025.

Oluwole, also known as Maye, filed a N5 billion lawsuit against Sinach over her 2016 hit song “Way Maker.” In the suit, numbered FHC/L/CS/402/2024, Maye is seeking a court declaration that he is a co-author and co-owner of the song. He also demands N5 billion in general damages for alleged infringements of his rights.

Among his demands, Maye is asking the court to order that any fees generated from licenses or copyright assignments of “Way Maker” be shared equitably between him and Sinach, given the absence of a formal agreement.

The lawsuit also seeks to compel Sinach to disclose all related licenses and assignments, and to account for any accrued fees due to him as a co-owner.

Additionally, Maye wants the court to declare that Sinach failed to finalize a written agreement for his contributions to the sound recording, affirm that his performer’s rights were infringed, and issue an injunction to prevent further reproduction or public performance of “Way Maker” without his consent.

Oluwole, through his legal representative Justin Ige, claims he worked as a studio engineer on the track, handling the recording, mixing, and mastering, and also created and performed instrumental accompaniments, including piano, strings, and synthesizers. He alleges that Sinach released the song without his consent or compensation and obtained licenses without sharing the proceeds, calling her actions “oppressive.”

In her defense, Sinach, represented by counsel Emeka Etiaba of Etiaba Chambers, denies the allegations. She maintains that she composed, arranged, and performed the song before involving Oluwole, who she claims only mixed the master recording for which he was paid $300. Sinach argues that no written agreement was required with him, and that he is not entitled to performer’s rights, copyright, or publishing royalties.

The trial, which began on November 27, 2024, was adjourned until January 29 and 30, 2025, allowing the defense to present its case.

Sinach, born Osinachi Kalu, is the first artist to top the Billboard Christian Songwriter chart for 12 weeks. “Way Maker” also earned her three nominations and won “Song of the Year” at the 51st GMA Dove Awards, making her the first Nigerian to win the prestigious award.
