APC Crisis: Enugu Party Chieftain Drags Ugo Agballa to Court

Ekohotblog reports that Uduji Kingsley, a chieftain of the All Progressives Congress, APC, in Enugu State has petitioned a Federal High Court sitting in the Federal Capital Territory, Abuja, to prevent Barr. Ugo Agballa from presenting himself as the party’s chairman in the state.

Agballa was said to have emerged as a factional chairman in one of the parallel congresses held in Enugu State.

In a complaint numbered FHC/ABT/65/1318/2021, the plaintiff, Uduji Kingsley, is now asking the Court to prevent Agballa from presenting himself as the State Chairman of the APC in Enugu State.

He informed the court that the alleged election that produced the defendant was unlawful, null and invalid, and violated Section 85(3) of the Electoral Act, as well as the All Progressives Congress, APC, constitution as modified in 2014.

The plaintiff is requesting the court to rule on whether a person who did not participate in the ward Congresses can participate in the State Congress on October 16 in violation of the terms of the Party’s constitution as revised in 2014.

He is praying the court to determine: “Whether the 1st defendant can validly register as a member of the 3rd Defendant in July 2021 in Enugu State contrary to the article 9.4 of the Party’s constitution and also the 2021 3rd Defendant’s membership registration guidelines.

“Whether the 2nd Defendant or any person however described in Enugu State can validly register the 1st Defendant as a member of the 3rd Defendant after March 31st, 2021 closure of the membership registration of the 3rd Defendant.”

The plaintiff sought the court to declare that: “That the 1st defendant cannot validly contest the position of the chairman or any other position however described in the October 16, 2021 State Congress of All Progressives Congress, APC.

“A declaration that the 1st Defendant cannot participate in the October 16, 2021 State Congress of the 3rd Defendant as it contravenes Section 85(3) of the electoral act as well as the membership registration guidelines of the 3rd Defendant”

“A Declaration that 2nd Defendant or any person however described in Enugu State, cannot register the 1st Defendant as a member of the 3rd Defendant after March 31st closure of the membership of the 3rd Defendant as it contravenes article 2, 7, 9.1 and 9.3 of the 3rd Defendants constitution.

“A declaration that 2nd, 3rd and 4th defendants cannot validly recognise the 1st Defendant as the Enugu State chairman of the All Progressives Congress APC as it contravenes article 2, 7, 9.1, 9.3 and 7 of the constitution of the 3rd Defendant.

“A declaration that the purported selection/election/declaration of the 1st Defendant as the duly elected chairman or Officer of the All Progressives Congress, APC, Enugu State contravenes the 2, 7, 9.1, 9.4, 12.7, 31.1 of the Constitution of the 3rd Defendant.”
