EKO HOT BLOG reports that the Candidate of the All Progressives Congress (APC), Jibrin Isah, has been affirmed by the Court of Appeal as the duly elected senator for Kogi East.
The Independent National Electoral Commission (INEC) had declared Isah the winner of the Kogi East Senatorial District election, but the candidate of the Peoples Democratic Party (PDP), who came second in the election, Victor Adoji, had challenged the return of Isah at the tribunal on the ground that elections were cancelled in some polling units.
Adoji implored the tribunal to invalidate Isah’s victory and mandate a supplementary election in the 94 polling units that were affected in the senatorial district.
In a unanimous ruling, the tribunal, presided over by Justice K.A. Orjiako, directed a rerun in the 94 polling units where irregularities occurred during the previous general election.
Nevertheless, Isah lodged an appeal challenging the verdict of the lower court.
On Thursday, the Court of Appeal overturned the tribunal’s ruling, thereby upholding the appellant’s triumph.
