ASUU: Court Dismisses ASUU’s Suit, Validates CONUA, NAMDA As Trade Unions
Eko Hot Blog reports that Justice Benedict Kanyip, President of the National Industrial Court in Abuja, has dismissed a suit filed by the Academic Staff Union of Universities (ASUU) challenging the Federal Government’s registration of the Congress of University Academics (CONUA) and the Nigeria Association of Medical and Dental Academics (NAMDA) as trade unions
According to Channels News, Justice Kanyip ruled on Tuesday that Section 27 of the Trade Union Act allowed for more than one trade union in employment.
According to him, the section does not show a trading monopoly. The court ruled that the then-Minister of Labour, Chris Ngige, and the Trade Union Registrar had the authority to register NAMDA and CONUA to coexist with ASUU.
The court also ruled that when ASUU filed the claim, it did not submit any proof to establish that CONUA and NAMDA were fully registered.
The court ruled that ASUU’s evidence was hearsay because the suit was brought on October 26, 2022, while CONUA and NAMDA registration had not yet been gazetted in accordance with Section 523 of the Trade Union Act.
The court also ruled that ASUU made a mistake by filing its complaint against NAMDA as the National Association of Medical and Dental Academics rather than the Nigeria Association of Medical and Dental Academics, a simple typo in a suit that appears only when a person has a Jurisdictional name or is in existence.
