Bayelsa Politics: Gov. Diri To Opposition Party, Give Peace A Chance

The All Progressives Congress (APC) has demanded a fresh election in Bayelsa State following the alleged unconstitutional swearing-in of the Peoples Democratic Party (PDP)  candidate as governor of the state.

According to Premium Times, the nationwide chairman of the celebration, Adams Oshiomhole, in a letter of appeal to the Independent National Electoral Compensation, attested the superiority of the Supreme Court nullification of its governorship candidate’s success, but argued that the sworn-in candidate, Duoye Diri, additionally fell short to meet the obligatory need to end up being the governor.

The letter, which was sent to the nationwide chairman of INEC, was labelled,’ Reasoning in Allure No: SC.1/ 2020 between Peoples Democratic Event Request for conduct of fresh governorship election in Bayelsa State’.

It claimed the court judgement did not void the ballots that the APC questioned at the election as well as the implication of this is that the votes of the celebration must be considered.

” Kindly remember that the Governorship election in Bayelsa State was carried out on the 16th November, 2019 and also our great event, the All Progressives Congress, properly got involved at the stated political election. You will additionally recall that the All Progressives Congress arised victorious at the election leading to our Lyon David Pereworinimi being stated and returned as champion of the political election,” the letter reads.

” Our interest has been drawn to the reasoning of the Supreme Court provided on 14th February 2020 in the pre-election allure filed by the Peoples Democratic Party( PDP) and also its governorship in addition to replacement governorship,” Mr Oshiomhole composed.

” In the stated judgement of the High court, the candidature of our governorship and also replacement governorship prospects were squashed and the compensation was ordered to provide fresh certification of returns with the highest variety of ballots and with the required geographical spread.

” It is however to be kept in mind that the High court did not invalidate the ballots that our celebration questioned at the election and the ramification of this is that the ballots of the All Progressives Congress must be reckoned with in identifying whether any other prospect surveyed majority of authorized ballots cast in one-quarter of at the very least two thirds bulk of the state.

” We have actually reviewed the judgement of the High court and also we are of the strong opinion that the prospects of the Peoples Democratic Celebration can not be released certification of return and or sworn in as the Guv and also Replacement Governor of Bayelsa State specifically.

” We understand that area 179( 1 )( b) of the 1999 constitution of the Federal Republic of Nigeria mandatorily calls for a prospect for an election to the workplace of governor of a state to have not less than one quarter of the ballots cast at the election in each of at the very least two thirds of all the local government areas in the state prior to the prospect can be deemed to have been properly elected as the Guv of the State. This mandatory need was verified by the supreme court in the judgement under referral.”

The letter highlighted that Bayelsa State has 8 local government locations, for this reason both thirds of at least 8 local government areas will be approximated to six city government locations.

“From the outcomes announced and duly released by the commission, it is clear that no candidates meet this compulsory constitutional demand, including the candidates of the Peoples Democratic Celebration who just managed to question one quarter of the votes cast in only 5 city government areas,” the APC claimed.

The celebration said its position is strengthened by the reality that there is a condition precedent to the victor being provided a certificate of return.

“The prospect of the Peoples Democratic Party or any other prospect whatsoever, none pleases the need of one quarter of the votes cast in at the very least 2/3 of the local government locations in the state as needed by the high court reasoning further demand that a fresh election be performed by the compensation for the workplace of the Executive Guv of Bayelsa State,” the letter highlighted.

Kindly remember that the Governorship election in Bayelsa State was performed on the 16th November, 2019 as well as our great event, the All Progressives Congress, duly participated at the claimed political election. We are aware of that area 179( 1 )( b) of the 1999 constitution of the Federal Republic of Nigeria mandatorily requires a prospect for a political election to the office of governor of a state to have not less than one quarter of the ballots cast at the election in each of at the very least two thirds of all the neighborhood federal government areas in the state before the prospect can be considered to have actually been duly chosen as the Governor of the State. This compulsory requirement was attested by the supreme court in the judgement under reference.”
