Malami Asks Court To Vacate Order Barring FG From Arresting Sunday Igboho
  • Court has again stopped AGF and the DSS from arresting, and blocking bank accounts of Sunday Igboho.

EKO HOT BLOG reports that the Oyo State High Court has again stopped the Attorney General of the Federation (AGF), Abubakar Malami, and the Department of State Security (DSS) from arresting, and blocking bank accounts of popular Yoruba Nation agitator, Sunday Adeyemo fondly known as Sunday Igboho.

Justice Ladiran Akintola of the Oyo High Court, on Monday, also restrained the DSS and the AGF from arresting, intimidating, harassing, and blocking the accounts of Sunday Igboho, noting that the application by the AGF is against fair hearing and the fundamental human rights of the applicant because it has to do with his free movement.

EKOHOTBLOG reports that the counsel for the AGF, Enock Simeon, had earlier appealed to the court to vacate its earlier judgment restraining the Federal Government (FG) from freezing Igboho’s account and arresting his allies, arguing that such judgment “is interim and could only stay for seven days”.

EKOHOTBLOG had reported that Justice Akintola of the Oyo High Court, on August 4, granted an ex-parte motion restraining the DSS and the AFG from arresting, intimidating, harassing, and blocking the accounts of Sunday Igboho.

However, the counsel for Igboho, Chief Yomi Aliyu (SAN), while objecting to the argument, said he had filed for an extension of the order on August 26, 2021, noting that the new application should not be granted.

The AGF lawyer, however, sought another adjournment for him to reply to the application as the time frame of seven days had not elapsed.

On his part, the counsel for the DSS, T. Nurudeen, said he had not been served with the new processes, urging the court to give a fair hearing to the parties by adjourning the case for hearing.

Justice Akintola refused to grant the application and therefore adjourned the case till September 7, 2021, for hearing.

EKO HOT BLOG recalls that Igboho had filed a motion seeking N5bn billion damages for invasion of his residence in Ibadan, the Oyo State capital on July 1, 2021.

Igboho, who is currently in detention in the Benin Republic, filed the suit at the court in Ibadan through his counsel, Chief Yomi Alliyu (SAN).

Igboho is contending that the invasion of his house in the Soka area of Ibadan was malicious and also amounted to a violation of his fundamental human rights.

EKO HOT BLOG recalls that the DSS had raided Igboho’s Ibadan residence in the Soka area on July 1, 2021, arrested about 12 of his aides, and killed two of them in a gun battle.
