The Court of Appeal sitting in Enugu has upheld the removal of Hon. Simon Atigwe of the Peoples Democratic Party (PDP) from the House of Representatives, affirming the ruling of the Election Petition Tribunal.
In its judgment, the court confirmed Hon. Dennis Nnamdi Agbo of the Labour Party (LP) as the rightful winner of the re-run election for the Igbo-Eze North/Udenu Federal Constituency, held on February 3, 2024.
The verdict was delivered unanimously by the three-member panel, with the lead judgment read by the panel’s chairman, Justice Ekanem.
Ifeanyi Ogenyi, one of the lawyers representing the Labour Party, confirmed the outcome in a statement on Wednesday.
“Congratulations to the people of Igbo-Eze North/Udenu Federal Constituency. The wheels of justice may turn slowly, but they do grind. Truth and justice have prevailed—Dennis Agbo has prevailed!” he wrote.
It will be recalled that the Independent National Electoral Commission (INEC) had initially declared Atigwe the winner of the re-run election. However, Agbo, who had originally won the February 25, 2023 general election but was later unseated by the appellate court, contested the re-run result at the tribunal and emerged victorious once again—this time affirmed by the Appeal Court.
