BREAKING: Federal High Court To Consider Suit For Minister’s Removal Over NYSC Membership

Eko Hot Blog reports that Federal High Court in Abuja has given the green light to a suit seeking to sack the Minister of Arts, Culture and Creative Economy, Ms. Hannatu Musa Musawa, over her membership of the National Youth Service Corps (NYSC).

The suit, filed by the Incorporated Trustees of the African Leadership & Transparency Development Initiative, argues that Musawa is not legally qualified to be appointed a Minister of the Federal Republic of Nigeria because she is still a serving NYSC member.

The plaintiff cited sections 66 (1) (f) and 147(5) of the 1999 Constitution, which state that no person should be appointed as a Minister of the Government of the Federation unless he or she is qualified for election as a member of the House of Representatives.

Section 66 (1) (f) of the Constitution also provides that no person should be qualified for election to the Senate or the House of Representatives if such person is employed in the public service of the Federation or of any State and has not resigned, withdrawn or retired from such employment 30 days before the date of election.

The plaintiff argued that Musawa, who was sworn in as Minister on August 21, 2023, is a public officer by virtue of being a current member of the NYSC.

The court has not yet fixed a date for hearing the suit.

If the court finds in favor of the plaintiff, Musawa would be forced to resign as Minister and refund all the salaries and allowances she has received since her appointment.

The Attorney-General of the Federation and Minister of Justice, Abubakar Malami, has been cited as the second defendant in the suit.
