EKO HOT BLOG follows the situation of Dani Alves, a Brazilian footballer, who recently has been accused of sexually assaulting a woman in a Spanish nightclub on December 30, 2022.
According to reports, the judge has been ordered Alves to be jailed without bail after analyzing the initial investigation by authorities and hearing testimony from the alleged victim, Alves, and a witness.
However, in an appeal filed by Alves’ lawyers, Alves has offered to wear a tracking device, turn in his passport, pay bail, and not leave Spain as a condition for his release.
The appeal states that Alves would report to the court and authorities as often as required and would not get within 500 meters of the accuser or her home or work place. He would also agree to wear a device that would allow authorities to monitor his whereabouts at all times.
Alves’ lawyers claim that the accusations alone were not enough to prompt his detention without bail and pointed out inconsistencies in the testimony of the alleged victim.
They also highlighted images that showed that the accuser was not forced into the bathroom where she claimed to have been assaulted. Alves initially denied having sex with the woman but later admitted to a consensual sexual encounter.
If found guilty, Alves could face up to 15 years in prison as per the Spanish sexual consent law passed in 2021.
The law takes into account a wide range of crimes, including online abuse, groping, and rape. Alves’ contract with Mexican club Pumas was terminated after his arrest, and he has also lost sponsorships.
The 39-year-old footballer has won 42 football titles, including three Champions Leagues with Barcelona and two Copa Americas with Brazil.
