  • Kano APC insists on challenging a court ruling over lack of jurisdiction

EKO HOT BLOG reports that the Kano State Government has rejected an Abuja High Judgement, nullifying the Governor Ganduje led APC Congresses, insisting the court lacks jurisdiction to hear the matter.

A Federal Capital Territory High Court in Abuja had nullified the congresses of the Kano State All Progressive Congress (APC) conducted by the Ganduje led faction of the party on Tuesday.

However, in response to the court’s decision, the State Attorney General and Commissioner for Justice, M. A Lawan, said the basis upon which the Court relied to give its Judgement cannot stand because the issue of jurisdiction is still valid.

He said the Kano government will appeal the judgement because as at the time the Ward Congresses were conducted in Kano they were done only by the authentic leadership of the APC led by Abdullahi Abbas.

The Attorney General said they are going to study the Judgement and appeal it, assuring that they would certainly get a judgement in their Appeal.

The Abuja High Court presided by Justice Hamza Muazu upheld the congresses conducted by Senator Ibrahim Shekarau’s led faction of the party.

The Judge ruled that the Shekarau led faction, ”tagged G-7” conducted an election that was signed by the 7- man committee of the APC.

Reports that the Applicants in the suit are Muntaka Bala Sulyman with 17, 980 members of the party while the defendants are members of the All Progressive Congress in Kano.

The first defendant is Mai- Mala Buni, Caretaker Chairman, Senator John Akpanudoedehe, the National Secretary and the Independent National Electoral Commission, as the fourth defendant.

The court held that all the congresses conducted by the Ibrahim Shekarau led faction are valid.

The applicants were represented by Barr. Nuraini Jimoh, SAN and the defendants were represented by Barr. Sule Usman, SAN, M.N. Duru and Mashood Alabelewe.

However, Barrister M. A Lawan said it was not true to say that the other faction of Shekarau had conducted Wards Congresses which was the basis of them having judgement, “we are the only ones who conducted Congress in Ward levels on that day and the documents are there to show”.
