EKO HOT BLOG reports that the Labour Party’s Lamidi Apapa faction has rejected the proposal for an interim government and the demand to postpone the swearing-in of President-elect Bola Tinubu on May 29th, while the presidential election tribunal reviews the petitions.
The faction believes that Tinubu’s inauguration would have no bearing on the legal dispute over the presidential election, which involves their party, the APC, and INEC.
In a statement issued on Wednesday, the faction’s spokesman, Abayomi Arabambi, stated that the Electoral Act and the Nigerian Constitution do not allow for a vacuum, and that “whether the President-elect is sworn in or not, there is a legal right to remove him if it is discovered that he was not duly elected.” Arabambi recalled how, in 2003, the court deposed Chris Ngige and installed Peter Obi as governor of Anambra.
Arabambi stated that only death and permanent incapacity could prevent a president-elect from being sworn in, citing Sections 136 and 146 of the constitution.
