Prof. Ndifon is currently on trial for alleged sexual harassment and gratification based on TKJ’s testimony that he coerced her into performing oral sex to gain admission into the LLB program.
However, in a no-case submission, Prof. Ndifon argued the court should acquit him, stating: “The chats show clearly that both 1 Defendant and TKJ have a consensual relationship where they expressed their love, affection, and worries for each other safety particularly that of the 1 Defendant.”
He claimed the text messages contained no threats or coercion, just the feelings between two lovers.
Prof. Ndifon also accused the ICPC of violating his rights by seizing his phones without a court order in a “desperate” bid to charge him. He said they unlawfully searched his phone for offenses upon seeing nude photos.
Additionally, he contended the court lacks jurisdiction because TKJ was not an original complainant and only emerged after amended charges were filed. He argued the cyberstalking and gratification charges fall outside the court’s authority.
Prof. Ndifon urged the court to decline jurisdiction for lack of due process in initiating the case.
