Former Kogi Governor, Yahaya Bello, has requested that the Federal High Court in Abuja adjourn his case indefinitely and vacate its arrest order, pending the determination of his appeal at the Court of Appeal.
Bello’s counsel, Musa Yakubu (SAN), made the request in a letter to the trial judge, Justice Emeka Nwite, citing the Court of Appeal’s rules and Supreme Court pronouncements.
He argued that the court no longer has jurisdiction over the matter since an appeal has been entered.
The EFCC had requested a variation of the arrest warrant and directed security agencies to carry out the arrest.
However, Bello’s counsel urged the court to decline the request and await the outcome of the appeal.
The letter also drew attention to a similar case where a Lagos High Court stayed proceedings pending the determination of an appeal.
Bello is facing charges of allegedly laundering N80 billion.
