The Court of Appeal, Abuja Division, on Friday, overturned the Federal High Court, Kano Division’s verdict regarding the appointment of Muhammadu Sanusi II as the 16th Emir of Kano.

EKO HOT BLOG reports that the appellate court, led by Justice Mohammed Mustapha, ruled that the Federal High Court had exceeded its jurisdiction by intervening in chieftaincy matters beyond its authority.

The lower court had nullified Sanusi’s appointment in response to a suit filed by Aminu Babba Dan’Agundi, who argued that the removal of the former emir, Aminu Ado Bayero, and the dissolution of the emirates violated his fundamental rights.

The Court of Appeal clarified that chieftaincy matters fall outside the Federal High Court’s jurisdiction under Section 251 of the Nigerian Constitution and declared Justice Abdullahi Liman’s ruling void. The appellate court further emphasized that the principal reliefs sought were chieftaincy-related and not connected to fundamental human rights.

In a similar case, the appellate court overturned the judgment of Justice Amina Aliyu of the Kano State High Court, who had barred Ado Bayero from acting as emir. The court ordered a fresh hearing, citing a breach of fair hearing principles.
