Presiding judge Justice A. Aderigbigbe upheld that vacancies exist in all 30 local government areas, in line with previous judgments by the Federal High Court and the Court of Appeal.
The court referenced the October 15, 2022, local government elections, which were nullified and voided by the Federal High Court ruling in FHC/CS/OS/103/2022 (APP vs. INEC & Ors) on November 30, 2022.
This decision was later affirmed by the Court of Appeal in Appeal No: CA/AK/226M/2024 (APM & Ors vs. APP & Ors) on January 13, 2025. The courts determined that the previous elections were invalid, thereby creating a vacuum in local council administrations.
