Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), has formally requested that Justice Binta Nyako of the Federal High Court recuse herself from his ongoing trial, expressing a loss of confidence in the court’s impartiality.

During a recent hearing, Kanu voiced his concerns regarding Justice Nyako’s management of his case, alleging that she had failed to comply with directives issued by the Supreme Court.

In response, Justice Nyako acknowledged his request and expressed her willingness to step down from the case. She indicated that she would forward the case file to the Chief Judge for reassignment and any necessary further actions.

Tensions escalated when Kanu, despite the intervention of his counsel Alloy Ejimakor, stood from the dock to address Justice Nyako directly.

He referenced a Supreme Court ruling that questioned the jurisdiction of the Federal High Court concerning the alleged broadcast that underpins his charges.

Kanu highlighted sections of the Supreme Court’s judgment that suggested perceived bias on the part of Justice Nyako, reinforcing his request for her recusal.

Since his re-arrest in Kenya in 2021, Kanu has faced ongoing legal challenges after previously fleeing from bail conditions set by the court.

Currently, he is facing terrorism charges but has pleaded not guilty. Despite his pleas, Justice Nyako has denied him bail, citing his past failure to adhere to bail conditions.

As the situation stands, Kanu remains in the custody of the Department of State Services, awaiting further developments in his case.
