A Federal High Court in Lokoja, Kogi State, has reversed its earlier ruling that restrained the Independent National Electoral Commission (INEC) from receiving a recall petition against Senator Natasha Akpoti-Uduaghan.

In a judgment delivered on Friday, the court upheld the constitutional validity of the recall process and affirmed the right of Kogi Central Senatorial District constituents to seek their senator’s removal. The court urged them to exercise this right in a lawful and orderly manner.

EKO HOT BLOG reports that this ruling comes a day after the court had granted an interim injunction barring INEC and its agents from receiving or acting on any recall petition. The injunction also halted any referendum by INEC on the matter until the Motion on Notice was determined.

The temporary order was issued following an ex-parte application filed by Anebe Jacob Ogirima and four other registered voters from Kogi Central.

Their request sought to stop INEC from processing any recall petition against Senator Akpoti-Uduaghan until a final court decision was reached.

With the latest ruling, the court has cleared the way for INEC to receive and act on the recall petition. The case has drawn significant attention, with growing calls from constituents dissatisfied with Senator Akpoti-Uduaghan’s performance.
