Eko Hot Blog reports that the legal tussle over the vacant stool of the Alaafin of Oyo has taken a new turn as the Oyo State High Court sitting in Awe has struck out a case filed by the Oyo kingmakers (Oyo Mesi) against Governor Seyi Makinde and other state officials.

The claimants, including the Bashorun, Lagunna, Akinniku, Areago Bashorun, and Alapo of Oyo, had sought a court injunction restraining Makinde and his agents from overruling their choice of candidate for the vacant stool.
However, Justice Ladiran Akintola ruled that the case was struck out due to an administrative defect, citing a lack of proof that Makinde was notified of the outcome of the selection process carried out by the kingmakers.
In the ruling, Justice Akintola stated, “This court found merit in the Notice of Preliminary Objection filed by the defendants/applicants against the claimants/respondents in this case. The same succeeds, accordingly all the issues raised for determination of this court by learned counsel on both sides are thereby resolved in favour of the defendants/applicants but against the claimants/respondents.”
The lead counsel for the claimants, Kunle Sobaloju (SAN), revealed that a notice of appeal and motion for injunction pending an appeal have been filed at the Court of Appeal and Oyo High Court, respectively.
Sobaloju argued that the duty to notify the governor lies with the Secretary of the Local Government and not the kingmakers themselves, asserting that they had provided evidence of forwarding their decision to the Secretary of Atiba Local Government.
The legal battle over the Alaafin stool intensified after the death of the late Alaafin of Oyo, Oba Lamidi Adeyemi III, who ruled for 52 years. The kingmakers had selected Prince Lukman Gbadegesin as their candidate to fill the vacant stool, a decision that sparked controversy and legal action.

As the case moves to the appellate court, the resolution of the Alaafin stool succession remains uncertain, with both parties vying to assert their respective claims and interpretations of the chieftaincy laws.
