EKO HOT BLOG reports that the claimants are seeking judicial interpretation on the duration of their tenure and the legality of another local government election conducted by the Osun State Independent Electoral Commission (OSSIEC) on February 22, 2025.
The suit, filed by Onibonokuta Saheed and seven others on behalf of the elected chairmen and councillors, is challenging the move to conduct fresh elections while their tenure is still valid. They dragged the Attorney General of the Federation, the Inspector-General of Police, the Attorney-General of Osun State, the Osun State Government, the State House of Assembly, and OSSIEC before the court.
Marked FHC/OS/CS/147/2025, the case questions whether OSSIEC acted lawfully in holding another election during an existing tenure. The claimants, elected on the platform of the All Progressives Congress (APC), also seek clarification on whether their tenure should last three years, starting from February 2025.
At Monday’s proceedings, presiding judge Justice Adefunmilola Demi-Ajayi stated that the court would ensure speedy hearing due to the nature of the matter.
Counsel to the claimants, Muhydeen Adeoye, moved a motion asking the court to restrain the defendants from removing the elected officials pending the determination of the case.
However, defence counsels — F. Labo-Popoola, Rachael Ojomi, and J. A. Ayanyemi — argued that they were still within the legal timeframe to respond to the originating summons.

Justice Demi-Ajayi directed the claimants’ counsel to ensure all court documents were properly served on the defendants before adjourning the matter to November 27 for hearing.
