Popular Businessman businessman Jailed For Contempt In Benin

A Benin City businessman, Mr. Charles Amadasun, has been committed to the Correctional Centre for contempt of court in a legal dispute involving him and Pastor Faustin Uwaibi.
Amadasun was accused of leasing a commercial property on Ihama Road, Benin City, through his company in 2003 for a 15-year term. However, he allegedly failed to pay the annual lease amount after the first year’s rent expired in 2004.

It is further alleged that he began subletting the premises to other tenants, misleading them into believing the property was his, and earning more than three times his rental obligations to the actual owner.
The property owner reportedly obtained a judgment against Amadasun amounting to nearly N100,000,000 (One Hundred Million Naira) and initiated contempt proceedings against him at the High Court in Benin City. Amadasun allegedly disregarded the court’s authority.

In Suit B/184/2009, Uwaibi filed for contempt, and in his ruling, Justice M. N. Asemota stated,
“I have considered the application for bench warrant to be issued against Mr Charles Amadasun Judgment Debtor sought to be committed to prison for contempt who has been personally served the required Forms 48 and 49 as well as the motion for committed and has refused to attend court.
“I have also read the affidavit in support in support of the application brought experte. I find merit in the application and it is granted as prayer.
“A bench warrant is hereby issued for the arrest of Mr Charles Amadasun to compel him to physically attend the court in respect of contempt proceeding against him.
“In this regard, he shall be arrested and committed to the Nigerian Correctional Service Benin Custodial Centre until he is brought to this court.
“This case is adjourned to Tuesday the 17th of September 2024 for hearing of the contempt proceedings.”
