The Federal High Court in Abuja has been asked to declare the Delta North Senatorial seat vacant following the defection of Senator Ned Nwoko to the All Progressives Congress (APC).
A suit filed by Marvis Ossai, a constituent and member of the Peoples Democratic Party (PDP), seeks an order directing the Independent National Electoral Commission (INEC) to conduct a bye-election within 60 days of the court’s judgment.

The legal action names Nwoko, INEC, PDP, and the Senate as defendants. Among the reliefs sought is an order for INEC to nullify Nwoko’s Certificate of Return and conduct fresh elections. Additionally, the suit demands that Nwoko refund all salaries, emoluments, and allowances received since January 2025 and be disqualified from holding elective office until he complies with the court’s ruling.

According to an affidavit deposed by Ibrahim Isa, the plaintiff argues that Nwoko’s defection violates the constitution, as there was no division within the PDP at the time of his departure. The suit contends that his continued representation under APC undermines the political mandate given to him by PDP voters in 2023.
The plaintiff also argues that Nwoko’s defection promotes “political harlotry” and legislative instability, which contradicts constitutional provisions regulating party-switching among lawmakers.
