INEC Chairman Mahmood Yakubu reportedly escaped arrest by the Nigeria Police Force after being accused of only partially complying with a Federal High Court order to restore the Action Alliance’s leadership on the commission’s portal.
Eko Hot Blog reports that Justice Funmilola Demi Ajayi of the Federal High Court, Osogbo, directed INEC Chairman Yakubu to reinstate Adekunle Rufai Omoaje as the Action Alliance National Chairman and recognize the party’s National Executive Committee from its October 7, 2023, convention.

The court order also instructed Yakubu to comply with the ruling within seven days or risk arrest by the Inspector General of Police, Kayode Egbetokun..
The judge gave the INEC chairman seven days to comply with the ruling or risk arrest by the Inspector General of Police, Kayode Egbetokun. While INEC reportedly uploaded the names of state chairmen elected under Omoaje’s leadership.

It allegedly failed to include Omoaje’s name as National Chairman and omitted the address of the party’s national secretariat. The portal also retained the name of the expelled former chairman, Kenneth Udeze.
This prompted the Action Alliance to file a fresh suit, accusing INEC of deliberate disobedience to the court order.
INEC, however, claimed it had complied with the judgment, a position the party rejected in an affidavit sworn to by its Osun State chairman, Mr. Araoye Oyewole.
The affidavit, dated October 2, 2025, stated that INEC’s action amounted to partial compliance and violated the clear directive of the court.
It noted that while some aspects of the judgment were implemented, INEC failed to fully restore Omoaje’s leadership as ordered by the court, thereby prompting further legal proceedings against the electoral body.
