SERAP Sues Tinubu Over N167bn Project Fraud, Demands Prosecution of Contractors

The Socio-Economic Rights and Accountability Project (SERAP) has taken legal action against President Bola Tinubu over the government’s alleged failure to prosecute contractors who received over ₦167 billion from 31 Ministries, Departments, and Agencies (MDAs) but failed to execute any projects.

The lawsuit, filed at the Federal High Court in Lagos, also names the Attorney General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), as a respondent. SERAP seeks a court order compelling the government to name and prosecute the defaulting contractors.

In the suit, SERAP argues that the mismanagement of public funds has deprived Nigerians of essential services and violates anti-corruption laws. The group wants the Minister of Finance, Olawale Edun, to disclose the names of the companies involved, details of the projects, and how much each contractor received.

“Holding these companies accountable will help combat waste, fraud, and abuse in public spending,” the lawsuit states.

SERAP insists that corruption continues to worsen the living conditions of Nigerians, increasing the cost of essential services like health and education.

The group cites the 2021 Auditor-General’s report, which revealed that over ₦167 billion was paid to contractors for unexecuted projects. It highlights that ₦100 billion was misappropriated within the Nigerian Bulk Electricity Trading Plc. (NBET) alone.

Other MDAs implicated in the report include:

  • Nigerian Correctional Service
  • National Pension Commission
  • Federal Medical Centre, Bida
  • Petroleum Technology Development Fund (PTDF)
  • Ministry of Niger Delta Affairs

SERAP is demanding full transparency and accountability in public spending and urges the court to ensure the recovery of misappropriated funds. No date has been fixed for the hearing of the suit.
