- A US appeals court has issued an order requiring individuals seeking mifepristone to obtain the medication in person from health clinics, effectively banning its delivery by mail or through pharmacies.
- The ruling stems from a lawsuit filed by the state of Louisiana against the Food and Drug Administration (FDA), challenging the regulations surrounding the distribution of the drug.
- Danco Laboratories, a major distributor of the pill, has requested a one-week stay of the order to prepare an emergency appeal to the US Supreme Court.
- Mifepristone is used in the majority of abortions in the United States and is also a standard treatment for managing early miscarriages.
A three-judge panel of the 5th Circuit Court of Appeals has delivered a significant blow to abortion access by overturning a lower court ruling that allowed mifepristone to be delivered via mail.
Eko Hot Blog reports that the conservative-dominated court’s decision mandates that the drug, which was originally approved by the FDA in 2000, must now be obtained in person.

This move has sparked immediate concerns from healthcare providers and advocates who argue that the decision prioritizes political agendas over established medical science and patient safety.
Louisiana Attorney General Liz Murrill hailed the decision as a major victory, claiming it ends what she described as illegal mail-order practices facilitated by the current administration.
In contrast, reproductive rights organizations have condemned the move, stating it is a calculated effort to make abortion services more difficult, expensive, and unreachable for millions of people across the country.
Legal experts from the American Civil Liberties Union (ACLU) noted that mifepristone has been used safely for over 25 years, and this restriction creates “immediate chaos” for pharmacies and patients alike.

The legal battle over mifepristone follows the 2022 Supreme Court decision to overturn Roe v. Wade, which led to approximately 20 states banning or severely restricting abortion.
While the Supreme Court previously rejected a bid to restrict the drug in 2024 due to a lack of legal standing by the challengers, this new order from the 5th Circuit brings the issue back to the forefront of the national legal landscape.
As Danco Laboratories prepares its emergency case, the future of medication abortion access remains uncertain for patients throughout the United States.
